「零件變中古」男怒罵：黑心 機車行告毀謗敗訴
裴姓男子（21歲）於去年5月6日下午1時，騎乘重型機車行經基隆市百福三街附近，因機
車皮帶斷裂、無形發動，牽至寇姓男子經營的機車行維修，更換原廠的皮帶、普利盤、普
利珠等物。
10天後，裴男再度將修好機車牽至友人開設的機車行，友人告知其更換的零件並非原廠是
中古零件，同日下午，裴男憤而跑至寇姓男子經營的機車行，怒罵其是「黑心機車行！」
，寇男憤而提出毀謗告訴。
基隆地方法院一審判決有罪，二審法官認為裴男並非故意捏造事實，是提出個人主觀之價
值判斷，判決裴男無罪，全案仍可上訴。
